General Terms and Conditions

1) This site and any contracts formed are governed by English law.

2) Overseas orders cannot be accepted at present.

3) The contract of sale is concluded by the issue of an invoice or delivery note via email or delivery by hand and any representative of the Purchaser is deemed to have authority to contract on such items.

4)  We are not responsible to you whether in contract, tort (including negligence) or otherwise for incidental, special , indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non performance of our obligations under these terms and conditions including such damage as may be reasonably foreseeable at the date you order the goods.

5) Nothing in these terms and conditions shall exclude or restrict our liability for death or personal injury caused by our negligence.

6) Our liability for any claim for loss or damage shall be limited to the sum paid by you for the goods. A person who is not a party to these terms and conditions shall have no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

7) If any provision of these terms and conditions is found to be invalid or unenforceable by a court the invalidity or unenforceability of such provision shall not affect the other provisions of these terms and conditions.

8) We may assign or transfer any of our rights or sub contract any of our obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with our specific permission in writing.

9) We reserve the right to change these terms and conditions from time to time and any such changes will be communicated on our website.

10) There are links on our website to third party websites which we believe may be of interest to you. We do not have any control over the content of these websites nor can we be liable in respect of anything contained on these websites.

11) These terms and conditions govern the entire trading relationship between ourselves and you and will remain in force for the duration of our trading relationship.

12) We will use reasonable endeavours to verify the accuracy of any product or pricing information which we place on the site but we make no warranties (whether express or implied) in relation to the accuracy of such information.

13) All data included in catalogues, circulars, advertisements, Websites and price lists of the Company shall be deemed to be approximate only.

14) We cannot guarantee that the appearance and/or colours of products shown on this site exactly reproduce the appearance and/or colours of the physical products themselves. Natural products may show some colour variations. All sizes quoted are approximate. Where Eco Air agrees to provide a specifically designed plan, the Customer agrees to check the accuracy and suitability of the plan.

15) All prices are subject to vat at 17.5% except where heat pump units are purchased as part of an installation package for domestic or charitable organisation use, in which case a preferential vat rate of 5% applies.

Installation

16) Before working with electricity, gas or water you should always consult an appropriate professional electrician or CORGI-registered plumber. Always read and follow any relevant manuals and safety instructions. When working with electricity always turn off the mains.

17) In connection with building work Eco Air cannot advise on planning permission or building regulation issues.  All professional installation should be carried out in accordance with the intallation manuals provided and is only recommended on products that are clearly labeled as such or as “DIY units”.  Any faults arising out of incorrect installation shall render the warranty void in so far as the fault arising as a result of the incorrect installation.

18) All professional installation shall be carried out by a qualified installer who is a member of the ACRIB (Air Conditioning and Refrigeration Industry Board) or a suitably qualified engineer.

19) The Customer is responsible for obtaining all necessary planning permission and local authority consents and permissions for any work to be carried out and allowing Eco Air or its agent to inspect these prior to the commencement of work.

20) All intellectual property rights (including use of trade marks) shall be solely owned by us. You are permitted only to use material on this website as expressly authorised by us . We grant you a limited, non-exclusive and revocable licence to access our website for the purposes of browsing our (or our affiliates) product offer(s), ordering goods or services from us (or our affiliates), or obtaining contact information for us (or our affiliates).

21) Any unauthorised use of material on this site is strictly prohibited.

22) You are expressly not permitted to download any part of our site (other than by reason of automatic page caching), to amend or modify it or any part of it, to reproduce or copy, sell (including any resale), or otherwise exploit our website (or any part of it) for any purpose other than as set out above, nor are you permitted to frame our website or to link to any element of it other than the homepage.

23) You are permitted to link to our homepage, provided that the link is not misleading, false, derogatory, or otherwise prejudicial to our affiliates’ interests, but you are expressly not permitted to use any of our logos or graphics either as or in connection with such a link unless our permission has been granted.

Ownership of Goods

24) Ownership of the goods remains with the Company and will not pass to the Purchaser until one of the following events occurs:

25.1 you have paid for all the goods and no other amounts are owed by the Purchaser in respect of other goods supplied by the Company.

25.2 The Purchaser sells the goods in accordance with these conditions in which case ownership will pass to the Purchaser immediately before the goods are delivered to the Purchaser’s customer.

26) The Purchaser must store the goods separately from any other goods until one of the following events occurs:

26.1) they become the Purchaser’s property; or

26.2) they are delivered to another buyer by the Purchaser.

26.3) If the Purchaser is overdue in paying for the goods or any other goods supplied by the Company, the Company may, if still the owner of the goods recover and resell them. The Company may enter the Purchaser’s premises for this purpose and may, if necessary, detach or remove the goods from any other goods. This does not affect any other right of the Company.

All split air conditioning units contain F Gas and is govern by F-Gas regulations. All F-Gas units must be handle by qualified F-Gas engineers.
